TERMS AND CONDITIONS OF SALE
ARTICLE 1: SCOPE OF APPLICATION AND MODIFICATION OF THE GENERAL CONDITIONS OF SALE
These general conditions of sale apply to all orders placed via the site www.bncl.fr (or .club) and via the company Binocle Eyewear.
Binocle Eyewear reserves the right to adapt or modify at any time these terms and conditions of sale. In case of modification, it will be applied to each order the general conditions of sale in force at the date of the order.
ARTICLE 2: AVAILABILITY OF THE PRODUCTS
All our articles are in stock unless otherwise stated on the product sheet.
The date of validation of the order corresponds to :
The date of the order in case of payment by credit card.
The date of receipt of payment in the case of payment by bank transfer.
In the event of an exceptional out-of-stock condition on one of the products in your order, you will be informed immediately about the restocking time. You can then either choose a similar product at a similar price in stock, or request a refund.
ARTICLE 3: ELECTRONIC VALIDATION OF ORDERS
Any order on www.bncl.fr has 4 steps.

An order will be considered valid when these 4 steps have been properly carried out.
ARTICLE 4: PRICE
Binocle Eyewear reserves the right to change prices at any time but will apply the prices in force at the time of your order, subject to availability at that time.
ARTICLE 5: TERMS OF PAYMENT AND SECURITY
In all cases the payment is made in Euros. The basket will automatically calculate the French VAT.
Methods of Payment
You can make the payment:
by credit card (if available) via the CIC 3DSECURE module (visa/mastercard)
by Bank Transfer
Retention of title clause
The products remain the property of Binocle Eyewear until full payment of the order by Binocle Eyewear.
Default of Payment
Binocle Eyewear reserves the right to refuse to make a delivery or to honor an order from a consumer who has not paid in whole or in part a previous order or with whom a payment dispute is being administered.
ARTICLE 6: TERMS AND DELIVERY TIMES
For a delivery in metropolitan France: 1 to 3 working days
DOM TOM & EUROPE : 3 to 7 working days
Rest of the world: 7 to 21 working days
The products are delivered to the delivery address that you indicated during the ordering process.
All shipments are sent by tracked mail.
We decline all responsibility in the case of delays due to strikes, natural disasters...
The shipping costs are free for more than 50€ of purchases in France and French overseas departments and territories.
Shipping costs remain the same in Europe and the rest of the world for orders over 50€.
All announced deadlines are calculated in working days. These are average times which correspond to the processing, preparation and dispatch times of your order. To this time, the delivery time of the carrier must be added.
The ordered product is delivered by the postal circuit and at the exclusive initiative of Binocle Eyewear, at the address on the order form. The announced deadlines are indicated at the departure of our warehouse.
If the products need to be returned to us, they must be the subject of a request for return to our Customer Service within 30 days of delivery. Any claim made after this period will not be accepted. The return of the product can only be accepted without damage and in their original new condition (packaging, accessories, manuals ...).
We advise you to check your delivery address during the order summary. In case of error on the shipping address, the shipping costs for a new shipment will be charged to the customer.
ARTICLE 7: RESPONSIBILITIES
Law N°2004/575 of 21 June 2004 (extract)
"The trader is automatically liable to the consumer for the proper performance of the obligations arising from the distance contract, irrespective of whether those obligations are to be performed by the trader who has concluded that contract or by other service providers, without prejudice to his right of redress against them.
However, he may avoid all or part of his liability by proving that the non-performance or inadequate performance of the contract is attributable either to the consumer or to the unforeseeable and insurmountable act of a third party or to force majeure. »
ARTICLE 8: RIGHT OF WITHDRAWAL
In accordance with article L.121-21 and following of the Consumer Code, the consumer has a period of 14 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund without penalty, with the exception of return costs.
Binocle Eyewear increases this period to 30 days, the return costs will be offered if a request is made beforehand on the tab "contact us". The return must be made at the rate of letter followed for metropolitan France / Dom-Tom and priority letter for the rest of the world. We will only reimburse up to the rates in force for these shipping methods. Do not hesitate to contact us in case of problems on : email@example.com.
The product must be returned in good condition, with all its accessories, and not used.
As far as possible, they must be returned to us in their original packaging and must not have been opened.
ARTICLE 9: RIGHT OF RETURN, EXCHANGE
You have a period of 30 days from receipt of your package to return your items (in part or in whole) see Article 8: "The return must be made at the rate of letter for metropolitan France / Dom-Tom and priority letter for the rest of the world. We will only reimburse up to the rates in force for these shipping methods. Do not hesitate to contact us in case of problems on: firstname.lastname@example.org."
In the case of an exchange, the return is at your expense but the shipping costs of the new shipment at the expense of Binocle Eyewear.
ARTICLE 10: GUARANTEE AND AFTER SALES SERVICE
Your pair of BINOCLE is guaranteed for 1 year from the date of purchase against manufacturing defects. This warranty is only valid on presentation of the original invoice issued by the authorized BINOCLE EYEWEAR dealer.
The non-agreed use of your pair of BINOCLE or the assembly of lenses of different brand (except BINOCLE corrective lenses) will result in the cancellation of the warranty. The guarantee does not work for scratches on the lenses. After analysis, if we find that the defect falls within the scope of the guarantee, we will repair or exchange the defective part.

ARTICLE 11: PROVISIONS OF THE LAW "INFORMATIQUE ET LIBERTES" (INFORMATION TECHNOLOGY AND FREEDOM)
At any time, you have the right to access, modify, rectify and delete data concerning you (art 34 of the law "Informatique et Libertés" of January 6, 1978).
